AI Disclosure per EU AI Act Art. 50

This platform creates content with the help of artificial intelligence (AI):

  • AI model: Anthropic Claude (USA) under EU Standard Contractual Clauses 2021/914
  • Data processed: brand description, voice samples, uploaded tenant files, public industry signals
  • AI-generated outputs: slide headlines, body copy, caption suggestions, image prompts, voiceover scripts, synthesized narration voice (TTS), and AI-generated background music (ACE-Step)

Publishing to social platforms happens only after human review: the platform generates and renders content for review, and only what an administrator explicitly releases via a publish confirmation is ever posted — nothing is published without that explicit release. Per Art. 50(1)+(4) of the EU AI Act we label all AI-generated content with an AI marker, and this labeling obligation applies bindingly to every published piece of content, without exception:

  • in the caption of every published post (e.g. "Created with AI — per EU AI Act Art. 50") — appended server-side at dispatch time from a dedicated, non-editable source and enforced by a fail-closed gate that stops the dispatch if the marker is missing
  • as an on-media footer badge in every rendered video and image
  • as the always-visible "AI-assisted" badge in the app
  • for deferred (scheduled) posts too: scheduled posts are Entradigm-held and pass through the same fail-closed gate at dispatch — the label cannot be disabled or removed

The AI label may not be removed. It is mandatory until counsel re-reviews the specific publication paths.

We do NOT use the AI for any of:

  • biometric classification of persons (Art. 5(1)(b))
  • social scoring (Art. 5(1)(c))
  • exploitation of vulnerabilities (Art. 5(1)(a)/(b))
  • predictive policing (Art. 5(1)(d))

Human oversight (Art. 14):

Every cycle is operator-reviewed (Approve / Park). No content is ever published without prior human review and an administrator's explicit publish confirmation.

Right to explanation (GDPR Art. 22 + AI Act Art. 14):

You have the right to receive an explanation of the AI's operation. Email contact@bykainsights.com.
